Dear Mr. Allen:
Chancellor Kibbee has asked that I reply to your letter. As you know, the Uni-
versity is currently engaged in contract negotiations with the Professional Staff
Congress. The New York State Public Employment Relations Board has certified
the PSC as the collective bargaining agent for a unit that includes adjuncts and
part-time faculty. This long delayed response to your letter was necessitated by
a careful investigation of the Taylor Law legalities with regard to the rights and
responsibilities of both employees and the employer in this instance.
You state in your letter that you are writing "on behalf of the Adjunct and Part-
Time Faculty Caucus", but fail to further identify this organization. If the
"Caucus" is an entity of the PSC, it would be appropriate for you to arrange
for any meeting with the Chancellor's Office through the regular channels
available to the union. On the other hand, even if the "Caucus" is not affil-
iated with the PSC, its members, individually and collectively, are represented
only by the PSC for purposes of collective bargaining with the University under
the PERB certification and unit determination ruling. The University could be
subject to an Unfair Labor Practice charge under the Taylor Law if it were to
meet with any employee or representative of an employee organization other
than the legal certified collective negotiation representative (in this case, the
PSC) for purposes of reaching any collective bargaining agreement.
| am certain that you recognize the constraints placed upon the University as a
public employer and appreciate its position under the law. Given these con-
straints and circumstances, it would be helpful if you could more clearly identify

and describe the employee organization you claim to represent. Should you
wish to meet with a member of my staff for this purpose, | would be happy to
make arrangements for such a meeting.
